HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.20197 of 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Technical Education for respondent No.1 and also recorded the offer of file vakalath by Sri P.Sree Ramulu Naidu, learned standing counsel for respondent Nos.2 & 3 and before notice to the 4th respondent and perused the prayer in the writ petition with the supporting affidavit and other material on record. The grievance of the petitioner is that under the guise of there is shortage of attendance, the petitioner is not considered for appearing the examination. As per the respondents, the petitioner secured 68% attendance. As per Regulation 5 Clauses (1) to (6) of the Academic Regulations 2013 (R13) for B.Tech (Regular-Full Time) of JNTU, 10% aggregate shortage of attendance can be condoned from 75% to 65%.

Once such is the case, when it is above 65% and within condonable limit that was not considered much less without any reason if at all not to condone. Once such is the case, the petitioner can be considered instead of wasting academic year, to appear whatever left over examinations as on today by virtue of this order and whatever fee payable can be collected even later and before declaring the results.

Accordingly and in the result, the Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, shall stand closed. No costs.
