Heard.

The revision is of the year 2010. Both parties stated, they have to get instructions as to the very suit O.S.No.248 of 2009 is pending or not.

A perusal of the grounds urged in the revision with reference to the impugned order, dated 30.04.2010, in I.A.No.348 of 2010 on the file of the Principal Junior Civil Judge, Machilipatnam, during pendency of the suit, shows the application for formulating additional issues was disposed of by amending issue No.1 and framing two (2) additional issues, against which the present revision is maintained. 4.

In fact, if at all there is pendency of the suit, liberty is given to the parties, if any cause of action survives, to file a fresh application before the lower Court.

With this observation, the civil revision petition is disposed of for nothing to keep the matter pending.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
