CVNR, J & MSKJ, J C.M.A.No.228 of 2015 29.12.2016 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Civil Miscellaneous Appeal is filed against the order and decree, dated 23.02.2015, in O.P.No.30 of 2012 on the file of the Additional Senior Civil Judge, Ananthapuramu. 2.

Mr.P.Sudarshana Raju, learned counsel for the appellant, addressed letter, dated 22.12.2016, to the Registry, wherein it is stated that both the parties have settled the dispute out of Court and that therefore, his client instructed him to withdraw the appeal. Today, at the hearing, the learned counsel for the appellant has reiterated the contents of the aforesaid letter.

In view of the above facts, the Civil Miscellaneous Appeal is dismissed as withdrawn.

As a sequel to dismissal of the appeal, interim order, dated 22.04.2015, in C.M.A.M.P.No.459 of is vacated and C.M.A.M.P.No.459 of 2015 filed by the appellant for interim relief shall stand dismissed as infructuous.
