THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.18500 of 2016 ORDER:
The petitioner joined in Central Reserve Police Force (CRPF) on 03.04.1991 and worked in several places. After working in Chattisgarh from 2008-2012, he was posted to Hyderabad as Head Constable. Since then he has been working at Group Centre, CRPF, Hakeempet, Ranga Reddy District. He is eldest in the family and looking after his aged parents who are suffering from several ailments. He applied for voluntary retirement with effect from 30.09.2016 by his letter, dated 11.04.2016. The 2nd respondent issued communication on 30.04.2016 for appearance in connection with the letter seeking permission to retire voluntarily. Without considering the said issue, when the 2nd respondent issued order of transfer on 01.06.2016, the present Writ Petition is filed.

Learned Assistant Solicitor General appearing for the respondents submitted that the petitioner's plea seeking voluntary retirement is only to avoid order of transfer and petitioner has option to withdraw the letter seeking permission to retire voluntarily. In those circumstances, this Court adjourned the matter twice in order to take instructions from the respondent authorities. After taking instructions, the counsel for the petitioner and the learned Assistant Solicitor General agreed for passing the following order:

Insofar as the letter of petitioner seeking permission to go on voluntary retirement w.e.f. 30.09.2016, on instructions, learned counsel for the petitioner submits that the petitioner would not withdraw the said letter on or before 30.09.2016 and the petitioner may be continued in the present post where he is working. Learned Assistant Solicitor General agrees for the same and submits that the order of transfer,
dated 01.06.2016, will be kept in abeyance so far as the petitioner is concerned till 30.09.2016.
4. Recording the undertaking of both parties, this Writ Petition is disposed of. It is needless to observe that the 2nd respondent shall process the application of the petitioner for voluntary retirement and pass appropriate orders thereon as expeditiously as possible. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
