THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.R.C. No.365 of 2016 ORDER :
The petitioner preferred the present Criminal Revision Case by invoking the provisions under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved by the order dated 16-11-2015 passed in S.C.No.151 of 2015 by the I Additional Sessions Judge, Kurnool, wherein and whereby the learned Judge has framed charges against the petitioner.
2. Heard and perused the material available on record.
3. The petitioner has filed the present application for discharge. Admittedly, the trial Court has framed charges. The petitioner, without approaching the concerned court, has approached this Court. This Court is of the view that the petitioner can file a fresh application before the concerned Court for discharge. On such application, the trial Court is directed to pass appropriate orders.
If the petitioner is aggrieved with such order, the petitioner is at liberty to approach this Court.
4. Accordingly, the Criminal Revision Case is disposed of.
5. Miscellaneous petitions filed in this revision, if any, shall stand closed.
