THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.8558 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused in Crime No.612 of 2022 pending on the file of Station House Officer, Banjarahills Police Station, Hyderabad registered for the offences punishable under Sections 342 and 376(1) of Indian Penal Code. 2.

Heard learned counsel for the petitioner/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is that he was a supplier of junior artists to film makers. The victim/LW1 was staying along with her friend in the house owned by the accused/petitioner. LW1 requested the petitioner for Rs.5,000/-, on which the petitioner asked her to come home and committed rape on her. The petitioner gave an amount of Rs.1,000/- asking her to collect remaining money in the evening, however, she refused. On the same day evening at about 09.30 PM LW1 again went to the house of the petitioner and asked him to give money, then the petitioner

allegedly asked her to sleep with him again and only then he will give Rs.5,000/- to her but she refused and left his house. 4.

As seen from the complaint the dispute is regarding some money. Even according to the remand report, the medical examination of the victim and other investigation is almost complete, for the said reasons, the petitioner can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused is granted bail subject to the following conditions:

i) The petitioner/Accused is directed to be released on bail on his executing personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties each for a like sum to the satisfaction of III Additional Chief Metropolitan Magistrate, Hyderabad.

ii) After release on bail, the petitioner/Accused shall appear before the concerned Station House Officer on every Monday and Thursday between 10.00 A.M to 1.00 P.M, for a period of eight (08) weeks or until filing of charge sheet, whichever is earlier.

iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.
