THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE S.RAVI KUMAR L.A.A.S.No.374 of 2009 JUDGMENT: (per Hon'ble Sri Justice Ramesh Ranganathan) The appellants herein are claimants 1, 3 and 8 in L.A.O.P.No.29 of 2002. The 4th claimant in L.A.O.P.No.29 of 2002 filed L.A.A.S.No.1104 of 2011 under Section 54 of the Land Acquisition Act seeking enhancement of compensation paid for the pomegranate trees. By order in L.A.A.S.No.1104 of 2011 dated 19.11.2014 a Division Bench of this Court modified the order of the Reference Court and granted compensation at Rs.2,000/- per pomegranate tree under Acategory with all statutory benefits. Pursuant to the amendment to the grounds of appeal, the appellants herein are now claiming Rs.3,000/- per pomegranate tree, Sri Ch.Srinivas, learned counsel for the appellants, would however submit that, in view of the judgment of this Court in L.A.A.S.No.1104 of 2011 dated 19.11.2014, the appellants herein are also restricting their claim to Rs.2,000/- per pomegranate tree.

Learned Government Pleader for Appeals does not dispute the fact that the subject matter of this Appeal is covered under the very same notification and the very same O.P., which was the subject matter of consideration in L.A.A.S.No.1104 of 2011.

Following the judgment in L.A.A.S.No.1104 of 2011 dated 19.11.2014, and in terms thereof, the present appeal is also disposed of enhancing the compensation payable for each pomegranate tree under A-category to Rs.2,000/- per tree with all statutory benefits on the enhanced amount. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs. ______________________________
