This writ petition is filed for the following substantive relief: "...to issue a Writ or Order or direction more particularly one in the nature of Writ of Certiorari and call for the records pertaining to Order dated 7.12.2006 passed in P.G.A. No.11 of 2005 on the file of the 1st respondent confirming the order of the 2nd respondent dated 14.1.2005, passed in P.G. Case No.8 of 2004 and consequently set aside the same."
At the hearing, there is no representation for the petitioner. A perusal of the proceedings sheet shows that this Court has permitted the counsel for the petitioner to take out notice to respondent No.3 with a default clause that if acknowledgement is not filed within two weeks, the writ petition shall stand dismissed qua respondent No.3 without further reference to the Court.
The office report shows that the acknowledgement of notice has not been filed by the petitioner and that the order of dismissal against respondent No.3 has come into effect. Since the relief is claimed against respondent No.3 alone, respondent Nos.1 and 2 being proforma parties, with the dismissal of the writ petition for non-service of notice against respondent No.3, the cause in the writ petition does not survive.
The writ petition is therefore dismissed as infructuous. As a sequel to dismissal of the writ petition, interim order dt.09.8.2007 passed in W.P.M.P.
