HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.29676 of 2013 ORDER:

This writ petition is filed seeking a direction to the 1st respondent to remove the encroachment on the passage and consequently direct the 1st respondent to take action for demolishing the illegal and unauthorised construction raised by the 2nd respondent in Premises No.14-3-64, Joshiwada, Goshamahal, Hyderabad. Learned counsel for the petitioner submits that the petitioner filed a representation before the 1st respondent on 27.12.2010 and no action has been taken till date.

Learned standing counsel for the 1st respondent submits that the petitioner may be directed to file fresh representation by enclosing the copy of the old representation and on receipt of the same, the officials of the 1st respondent-Corporation will take necessary action against the 2nd respondent, in accordance with law. In view of the above submission of the learned standing counsel for the 1st respondent-Corporation, the petitioner is given liberty to file a fresh representation setting out his grievances, within two weeks from the date of receipt of a copy of this order, by enclosing the representation dated 27.12.2010, to the Assistant City Planner of the 1st respondent-Corporation, and on such filing of the representation, the Assistant City Planner of the 1st respondentCorporation is directed to take appropriate action against the 2nd respondent, within a period of eight (8) weeks thereafter, in accordance with law.

The writ petition is, accordingly, disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
