When the matter is taken up for hearing, it is noticed that the petitioner has attained the age of superannuation and the petitioner is seeking for assigning seniority from 30.11.1967 in the category of LDC and the same was negatived by the respondent vide proceedings dated 21.08.2004. This Court is of the considered view that in view of retirement of the petitioner, the cause in the writ petition does not survive. Accordingly, the writ petition is dismissed as infructuous.
