HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.7694 of 2018 ORDER:

The petitioner, who is A2 in Crime No.23 of 2018 on the file of Oravakal Police Station, Kurnool District, filed the present application under Sections and Cr.P.C.

seeking enlargement on bail in the above crime, registered originally for the offence punishable under Section 304-A I.P.C. on 25.01.2018 and later altered to Sections 364, 302, 177, 109, 120B r/ w 34 I.P.C. 2.

Heard learned counsel for the petitioners and learned Public Prosecutor representing the State.

The petitioner/ A2 herein, A5 and A6 were examined as LWs.24, 1 and 3 respectively. It is from the report of A6 as if the deceased met with accidental death under wheels of a lorry. In the course of investigation, it came to light that the deceased no other than husband of the petitioner/ A2 and she arranged by engaging A5 and A6, Mahindra XUV 500 bearing No.TS 07 F X 1404 on the pretext they are going to Mahanandi temple along with A5 and A6 and in the way alightening the vehicle, drawn the deceased on the road in front of a lorry coming from Bethamcherla and its kidnap with false pretense and murder and mis-directing police with false report, as if accidental death.

The contention of the learned counsel for the petitioner is that the petitioner is innocent and falsely implicated before rigoring out from the bereavement of her husband and she has to take care of her family and that she went unsuccessful in Crl.MP.No.1089 of 2018, dated 13.07.2018 before the Court of

Dr. SSRB,J Sessions along with A1 in getting bail covered by a detailed order and it speaks that to get insurance money as a murder for gain by abduction deliberately A2 with the assistance of others killed the deceased. Hence, in the factual matrix, the petitioner even a lady, not entitled to the concession of bail, that too, pending further investigation.

Accordingly, the Criminal Petition is dismissed. 6.

Consequently, miscellaneous petitions, if any shall stand closed.
