Bonthu Kamalavathi (Died) v. Dy Registrar And 2 Others
HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND HON'BLE SRI JUSTICE RAMESH RANGANATHAN WRIT APPEAL No.290 of 2017 JUDGMENT: (per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) Sri Sai Gangadhar Chamarthy, learned counsel for the appellants, submits that he no longer appears for the appellants and the party who engaged him has taken back the file and the learned counsel has relinquished the engagement. We record his submission. 2.
We have gone through the Writ Appeal and the order impugned in the Writ Appeal. The learned Single Judge has held that in view of the finality of the sale, the sale confirmation and issuance of Sale Certificate which followed the arbitration award under the Cooperative Societies Act, nothing survives for adjudication and the Writ Petition itself has become infructuous. We do not see any ground to take a different view. 3.
The Writ Appeal fails and is, accordingly, dismissed. Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
