HON'BLE SRI JUSTICE D.V.S.S.SOMAYAJULU IA.No.1 of 2018 And A.S.No.595 of 2009 JUDGMENT:

This appeal is filed against judgment and decree dated 21.04.2009 in OS.No.121 of 2005 passed by the Additional Senior Civil Judge, Eluru, West Godavari District. IA.No.1 of 2018 is filed to permit the parties to enter into a compromise.

Both the appellant and respondent are present in the Court. They have filed their Aadhar Cards in proof of identity, which were counter signed by the respective counsel.

On enquiry, both the parties state that they have voluntarily entered into a compromise; that in addition to the amount deposited earlier, an sum of Rs.4,25,000/- (Rupees four lakhs twenty five thousand only) was settled in full satisfaction of the decree dated 21.04.2009. The payment was made in open Court and respondent himself acknowledged the receipt of the entire compromise amount of Rs.4,25,000/-.

In view of the payment of 1/3rd of the decretal amount pursuant to the order of this Court in ASMP.No.1815 of

2009 and the further payment of Rs.4,25,000/- in the Court, IA.No.1 of 2018 is allowed and full satisfaction of the decree and judgment dated 21.04.2009 in OS.No.121 of 2005 is recorded.

Consequently, the appeal is disposed of in terms of the compromise. No order as to costs.

As a sequel, miscellaneous petitions, if any, pending in this appeal shall stand closed.
