Sri. Medasetty Bhaskara Rao, v. The State Of Andhra Pradesh Rep. By Principal Secretary,
THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITON No. 25554 OF 2016 ORDER:
Heard.
2. The case of the petitioner is that by inheritance he along with his brother Medisetty Apparao got an extent of Ac.1-34 cents of agricultural land in Sy.Nos.174-30, 174-27, 174-26 and 174-25 situated at Asakepalli Village, Sabbavaram Mandal, Visakhapatnam District and they got partitioned the said property equally i.e., Ac.0-67 cents each. However, subsequently his brother entered a settlement before family elders in the year 2002 itself and has relinquished his right over his share before the 3rd respondent-Tahasildar, Sabbavaram Mandal, in lieu of part loan. While so, the respondent authorities without issuing any notice have categorized his lands as disputed survey/lands in Pattadhar Adangal in the online web site in www.meebhoomi.ap.gov.in. Thereby, he would not be granted any loan for the agriculture. Therefore, questioning the action of the 3rd respondent, the present writ petition is filed.
3. Perused the records. In order to show the possession of the petitioner over the land, what all has been filed before this Court is only adangal copy and there is no challenge by the petitioner to the underling proceedings under which said changes have been affected.
4. It is well settled that as per the procedure contemplated under the ROR Act, any person aggrieved by the changes in the revenue records has to approach the recording authority seeking information with regard to the said changes. Further, the web site entry is only for the purpose of information to enable the citizens to have online access without approaching the revenue officials.
5. In the case on hand, petitioner instead of approaching the revenue officials seeking information, has straight away approached this court complaining mala fidies on the part of the respondent
authorities. Inasmuch as, the necessary procedure as contemplated under the Act is not followed, petitioner is given liberty to approach the revenue officials seeking information and after obtaining information with respect to the proceedings under which the revenue officials have been made, he shall exercise his right in terms of the Act.
6. Subject to the above observation, this writ petition is closed, leaving it open to the petitioner to work out his remedies as available under law.
As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
