THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 27088 OF 2017 O R D E R:
This writ petition is filed seeking to declare the action of respondent No.2-A.P.Cooperative Appellate Tribunal, Vijayawada in not passing orders in OASR No.180 of 2017 filed by the petitioner aggrieved by the order, dated 03.07.2017, passed by respondent No.4-Divisional Cooperative Officer/Sale Officer, Vizianagaram in EP No.38 of 2010-2011 in ARC No. 106 of 2001/2002, as illegal and arbitrary.
The petitioner asserts that she filed the appeal along with applications seeking to grant stay of the order, dated 03.07.2017, and to dispense with the filing of the same. She further asserts that while the matter is pending before respondent No.2, respondent No.4 has initiated proceedings for execution of the order, dated 03.07.2017. Hence, he approached this Court seeking appropriate orders.
Heard learned counsel for the petitioner.
Learned Government Pleader for Cooperation appearing for the respondents submits that as on date, the auction proposed to be conducted has been postponed and thereby, he prays for disposal of the writ petition with a direction to respondent No.2 to
pass appropriate orders either in the stay application or in the appeal.
Having considered the respective submissions and since the petitioner filed OASR No.180 of 2017 along with stay application as well as dispense with application on 02.08.2017, the writ petition is disposed of with the direction to respondent No.2 to pass appropriate orders either in the stay application or in the appeal, within a period of six weeks from the date of receipt of a copy of this order.
Consequently, miscellaneous applications, if any shall stand disposed of. No costs.
