THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11669 of 2025 ORAL ORDER:
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused Nos.3 in Crime No.506 of 2025 before the Madhura Nagar Police Station, Hyderabad.

The brief facts of the case are that on 25.07.2025, the de facto complainant was allegedly assaulted by Mrs. Arundhathi @ Swathi, her mother, and mother-in-law. They pulled her hair, hit her on the back, abused her in filthy language, and threatened to kill her. The complainant further stated that in the year 2021 she had a relationship with Arundhathi's husband, Mr. B. Chandrashekar, who allegedly exploited her under the promise of marriage. After she filed a complaint with the SHE Team in 2024, both were counselled, and she cut off contact. Despite this, the accused allegedly attacked her again in July 2025.

Heard Sri Rama Rao Immaneni, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the petitioner was innocent and falsely implicated to pressurize him in a civil property dispute. He further submitted that the complainant had taken large sums of money from the petitioner for investments and later entered into an agreement of sale for a flat but failed to execute a registered deed. When the petitioner filed a civil suit for specific performance and obtained a status quo order, the complainant lodged the false criminal case to harass him. He contended that the alleged acts did not constitute the offences charged. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the same stating that the allegations leveled against the petitioner are serious in nature. He further submitted that the investigation was not yet completed. At this stage,
granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both learned counsel and upon perusal of the material available on record, it appears that the parties have been in a relationship since 2021. Despite knowing that the petitioner was married to accused No.1, no complaint was lodged against him at that time. Even when a report was filed in 2025, no allegation was made attracting Section 69 of the BNSS. Therefore, considering the facts and circumstances of the case, this Court deems it just and proper to grant pre-arrest bail to the petitioner, subject to the following conditions: i.
The petitioner shall surrender before the Station House Officer, Madhura Nagar Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on his executing a personal bond for Rs.25,000/- (Rupees
Twenty five thousand only) with two sureties, for the like sum each.
ii.
The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
