THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE U. DURGA PRASAD RAO CONTEMPT CASE NO.1115 OF 2015

O R D E R

(per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging disobedience to the order dated 02.03.2015 passed by this Court in PIL No.38 of 2015. The said order required the Assistant Commissioner of Endowments, Ranga Reddy District, State of Telangana, to look into the complaint made by the petitioner and take necessary legal steps if he found the complaint to be correct.

The Assistant Commissioner, Endowments Department, Ranga Reddy District, filed a counter-affidavit dated 30.09.2015, which was taken on record on 09.10.2015. Therein, he specified various steps which had been initiated to free the temple lands from encroachments. Details were furnished of the O.As. filed by the authorities before the Endowments Tribunal for removal of the encroachments and the various other steps taken by the endowments authorities to safeguard and protect the temple lands.

Though time was sought on 09.10.2015 for filing a reply, no reply has been filed by the petitioner and again a request is made today when the matter is taken up for hearing for further time to file a reply. In the light of the uncontroverted averments in the counter-affidavit as they presently stand, this Court finds no grounds made out for exercising contempt jurisdiction as various steps have been initiated by the authorities pursuant to the order passed by this Court in PIL No.38 of 2015.
