THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN WRIT PETITION No.4971 of 2001 ORDER: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) We have heard Sri V.Raghu, learned counsel for the petitioner, and Sri Suri Babu, learned Special Government Pleader for Taxes, appearing for the respondents. While we see that there was an interlocutory order stating that, there should be stay of collection of sales tax only upto 02.02.2001, the fact of the matter remains that the withdrawal of the exemption from sales tax does not survive the judgment in Surya Mineral Waters, Somavarapadu, Denduru Mandal, West Godavari District v. Commissioner of Industries and Chairman State Level Committee, Hyderabad1, which has been rightly brought to our notice by the learned counsel for the respondents.
In the light of the above, we allow this Writ Petition and order that it will be governed by the declarations and directions as also regulatory orders as have been issued by this Court through the order in Surya Mineral Waters's case (supra). The miscellaneous petitions pending, if any, shall stand closed. No costs.
