THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11416 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief: "to issue Writ, Order or Direction one in the nature of WRIT OF MANDAMUS declaring the inaction on the part of the Respondent in regularising the services of the petitioner in the appropriate post or in the post of Attender's cadre with payment of timescale of pay attached to the said post, as per G.O.Ms.No.212 Finance and Planning (FW.PC.III) Department, dt. 22-04-1994 and G.O.Ms.No.391 Revenue (Endt.III) Department dt.6-5-1991 of the Government of Andhra Pradesh as illegal, arbitrary, bad in law, violative of Art.

14 and 21 of the Constitution of India and consequently direct the Respondent to regularise the services of the petitioner in the appropriate post or in the post of Attender's cadre with payment of timescale of pay attached to the said post, as per G.O.Ms.No.212 dt.22-4-1994 and G.O.Ms.No.391 Revenue (Endt.lII) Department dt.-6-5-1991 of the Government of Andhra Pradesh with all consequential and attendant benefits and pass such other order or orders may deem fit and proper in the circumstances of the case."

2. Heard Sri P.Venkata Rama Sarma, learned counsel for the petitioner and Sri A.K.Jayaprakash Rao, learned Standing Counsel for the respondent.

When the matter is called, it is submitted by the learned counsel for the petitioner that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 19.08.2015 to the respondent herein and no action has been taken on the said representation so far. It is further requested by the learned counsel that necessary direction may be issued to the respondent to pass appropriate orders on the said representation, in accordance with law, by fixing some timeframe. The said

request is not opposed by the respondent.

4. Recording the said submission and having regard to the nature of controversy, Writ Petition is disposed of, without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioner, directing the respondent herein to consider and pass appropriate orders on the representation dated 19.08.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of two months from the date of receipt of a copy of this order.
