THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6508 of 2015 ORDER:
This criminal petition, under sections 437 & 439 of the Code of Criminal Procedure, is filed by the petitioners-Accused Nos.3, 4 and 5 seeking grant of bail in connection with Crime No.99 of 2015 on the file of Hayathnagar Police Station, Ranga Reddy District, registered for the offence under Section 20 (b) of the Narcotic Drugs and Psychotropic Substances Act.
The case of the prosecution is that on credible information, the Inspector of Police, Hayathnagar P.S., conducted search at Peddamberpet village at outer ring road on NH 65 and apprehended the petitioners, who alleged to have brought huge quantity of ganja from Rajahmundry of East Godavari District, to supply the same at Hyderabad and Narayankhed of Medak District and also other states, in a DCM Van by escorting a Swift Car. On checking of the Swift Car, the police found 2 kgs., of ganja in five packets and on checking of the DCM van, they found 225 packets of ganja each weighing 2 kgs. The total weight of the ganja is 460 kgs. After completion of panchanama, police arrested the accused and seized the ganja. Basing on the mediators report, the above said crime was registered. Heard and perused the material available on record.
A perusal of the record discloses that the seized ganja is about 460 kgs., which is more than the commercial quantity. Hence, this Court is not inclined to grant bail to the petitioners at this stage. Accordingly, the Criminal Petition is dismissed.
