THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11683 of 2025 Seeking the Court to enlarge the petitioner who is arrayed as accused No.1 in FIR No.555 of 2025 of Keesara Police Station, Kushaiguda Rachakonda Commissionerate, on bail, the present Criminal Petition is filed. 2.

The brief facts of the case are that on 19.07.2025, the de-facto complainant lodged a report before the Police stating that the de-facto complainant's second brother by name Venugopal married to petitioner/accused No.1 about eight years ago. After their marriage, both petitioner and her deceased husband resided in a rented room near the railway gate at Bolarum. While de-facto complainant's second brother went out on duty, it was alleged that the petitioner herein has developed an illicit relationship with their house owner by name Krishna. Further alleged that, on discovering this, his deceased brother reprimanded the petitioner and advised her to mend her ways. It was also alleged that, petitioner did not change and instead frequently quarreled with him and being distressed by her behavior, the deceased brother shared his concerns with the complainant. Later, panchayat was held in

the presence of elders, during which, the other petitioners allegedly threatened the complainant's brother with dire consequences. It was further alleged that, petitioner did not mend her behaviour and allegedly assaulted their daughter, Daksha Sree, and made threatening phone calls to the complainant's deceased brother from other petitioners, who had also abused the deceased in filthy language. She also threatened to file a false case against the deceased. Additionally, she is said to have harassed him, demanded a divorce, and told him to die so that she could remarry. Unable to bear the continuous harassment from petitioner and other Petitioners, on 17.07.2025, the deceased brother of the complainant consumed paraquat poison.

It was alleged that the complainant along with his brother Muthe Srinivas, immediately rushed to the complainant's brother's residence and shifted him to Srikara Hospital in a car. After initial treatment, he was referred to Pranadhara Hospital, Chinthal, for better care. On 19.07.2025, the complainant's brother died while undergoing treatment. Hence, he requested for necessary legal action. Basing on the said complaint, the police registered a case in Crime No.555 of 2025 for the offences punishable under Sections 108, 351(3), 352 r/w section 3(5) of BNS.

Heard Sri M. V. Hanumantha Rao, learned counsel appearing on behalf of the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioner submitted that the petitioner is innocent of the alleged offences. It is further submitted that there is no name of the petitioner herein in the dying declaration of the deceased. It is further submitted that the petitioner was sent to judicial custody on 19.08.2025. It is further submitted the investigation was already completed and all other accused were granted bail. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record,

it appears that the petitioner herein is in jail from 19.08.2025 and as seen from the record, material part of the investigation was already completed and all other accused were granted bail. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned III Additional Judicial Magistrate of First Class, Medchal Malkajgiri District, at Kushaiguda.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
