THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8573 OF 2022 O R D E R:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking pre-arrest bail to the petitioners/Accused Nos.1 to 4 in the event of their arrest in connection with Crime No.124 of 2022 on the file of Station House Officer, Nalgonda Rural Police Station, Nalgonda registered for the offences punishable under Section 306 of Indian Penal Code and Sections 3(1)(r)(s), 3(2)(v) of SC/ST POA Act, 2015. 2.
Heard the learned counsel for the petitioners/Accused Nos.1 to 4 and the learned Assistant Public Prosecutor for the respondentState. Notice sent to the 2nd respondent. Perused the record. 3.
According to the complaint, these petitioners and the deceased belong to the same family. They picked up quarrel with the deceased (father of the de facto complainant) and also the de facto complainant's uncle and abused them in a language attracting penal consequences under SC/ST Act. Further Accused No.1 filed a criminal complaint against both the deceased and the uncle of the de facto complainant. Unable to bear the humiliation of a criminal
complaint being filed, the father of the de facto complainant consumed poison and committed suicide.

Admittedly, the 1st petitioner/Accused aggrieved by the conduct of the deceased and the uncle of the de facto complainant, filed a complaint before the concerned police station. The said act of the 1st petitioner would not amount to abetting suicide. For the said reasons, these petitioners can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioners/Accused Nos.1 to 4 are granted anticipatory bail subject to the following conditions:
i) The petitioners/Accused Nos.1 to 4 are directed to surrender before the Station House Officer, Nalgonda Rural Police Station, Nalgonda within ten (10) days from today and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties to the like sum each, to its satisfaction. ii) The petitioners/Accused Nos.1 to 4 shall appear before the Station House Officer, Nalgonda Rural Police Station, Nalgonda on
every Monday between 10.00 A.M to 1.00 P.M, for a period of eight
(08) weeks and thereafter as and when required for the purpose of investigation.
iii) The petitioners/Accused Nos.1 to 4 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, if any pending, shall stand closed. ____________ K.SURENDER,J Date: 21.10.2022 ns
