This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking pre-arrest bail to the petitioner, who is arrayed as Accused No.1 in the event of his arrest in Crime No.1214 of on the file of Station House Officer, Vanasthalipuram Police Station, Rachakonda registered for the offences punishable under Sections 370(A)(ii) of Indian Penal Code and Sections 3(1)(2)(a), 4, 5(1)(a) and 7 of PIT Act. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State. Perused the record. 3.

On instructions learned Assistant Public Prosecutor submits that this petitioner was shown as absconding and the investigation is still pending.

In view of the submission of the learned Assistant Public Prosecutor, this Court is of the opinion that he cannot be granted the relief of anticipatory bail. However, the petitioner if so advised

Crl.Petition No.8569 of 2022 to surrender before the concerned Court within one week by filing an application seeking regular bail and upon such surrender the concerned Court shall dispose off the bail application on the very same day on merits after giving opportunity to the learned Public Prosecutor.
