HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY C.R.P. No. 1163 OF 2011 ORDER :
This Court, by order dated 01.04.2011, while issuing notice before admission, granted interim stay of arrest of the petitioner pursuant to the order under revision subject to the condition that the petitioner deposits half of the decretal amount together with costs to the credit of E.P.No.72 of 2008 in O.S.No.105 of 2003 on the file of the Court of Senior Civil Judge, Tadepalligudem within eight (8) weeks from today.
On 15.11.2011, the respondent/plaintiff was permitted to withdraw the same, without furnishing any surety. Heard learned counsel for the petitioner, who states that the petitioner requires two months time for depositing the balance of decretal amount, for which, learn counsel for the respondent has not objected.
In view of no objection expressed by the learned counsel for the respondent, without going into the merits of the case, this Civil Revision Petition is disposed of granting two (2) months' time to the petitioner to deposit balance of decrial amount. On such deposit, the respondent/plaintiff is permitted to withdraw the same, without furnishing any security.
In default, it is open for the respondent/plaintiff to initiate proceedings for execution of the impugned order.
Accordingly, this Civil Revision Petition is disposed of. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any pending in this CRP, shall stand closed.
