THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9476 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue writ of Mandamus to declare the action of the respondents in not considering petitioners representation, dt.15-3-2016 for regularizing them from their services in the cadre which they are working, as illegal, arbitrary, contrary to Rules, consequently direct the respondents to consider petitioners representation, dt.15-3-2016 for regularizing Petitioners from their services as per their designation in the office (APSAC)." Heard Sri V. Venkateshwara Rao, learned counsel for the petitioners and learned Government Pleader for Finance and Planning for respondents.
When the matter is taken up, it is submitted by learned counsel for the petitioners that for redressal of the grievance of the petitioners, the petitioners herein submitted a representation on 15-03-2016 to the 3rd respondent herein and no orders have been passed on the said representation so far. A request is made by the learned counsel for the petitioners to direct the 3rd respondent to pass appropriate orders on the representation, dated 15-03-2016, in accordance with law, by fixing some timeframe. The said request is not opposed by learned Government Pleader for respondents and submitted that the said representation would be considered, in accordance with law.
For the aforesaid reasons, the writ petition is disposed of,
without expressing any opinion on the merits and demerits of the matter and entitlement of the petitioners, directing the 3rd respondent to consider and pass appropriate orders on the representation, dated 15-03-2016 said to have been submitted by the petitioners herein, in accordance with law, within a period of two (2) months from the date of receipt of a copy of this order. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
