HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Tr.C.M.P.No.475 OF 2016 ORDER:
The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw O.P.No.224 of 2016 from the file of Judge, Family Court, Ranga Reddy District at L.B. Nagar, and transfer the same to the file of Judge, Family Court, Ongole.
2. Heard Sri Venkateswarulu Sanisetty, learned counsel for the petitioner.
3. The postal endorsement shows that the respondent unclaimed the notice. In fact, the very same address, which is mentioned in the said O.P. by the respondent, was shown in the present transfer petition and notice was addressed to the same address.
4. Learned counsel for the petitioner would submit that the petitioner is unable to even maintain herself and she filed an F.C.O.P. on the file of Judge, Family Court, Ongole, for restitution of conjugal rights, and out of the wedlock of the parties, a child was born, who was aged one year eight months on the date of filing of the petition.
5. Keeping in view, the financial constraints as well as lack of male assistance to accompany the petitioner and that the petitioner has to take the child also to the Court, the request of the petitioner is acceded to.
6. Hence, the present transfer petition is allowed. Consequently, O.P.No.224 of 2016 pending on the file of Judge, Family Court, Ranga Reddy District at L.B. Nagar, is withdrawn and transferred to the file of Judge, Family Court, Ongole, for disposal in accordance with law. The transferee Court shall issue notices to the parties on receipt of the case bundle.
Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J April 18, 2018.
