THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21552 of 2017 ORDER:

The petitioners challenge notice dated 30.07.2016. The basis for challenge to the notice is that the 4th respondent proposing to lay road through Sy.Nos.313 and 372 of Remidicherla Village, Yerrupalem Mandal, Khammam District, which is assigned land, by ignoring the road in existence as per field map/ village map. The petitioners filed representations on 24.11.2016 and 29.05.2017 for consideration and favourable orders by respondents 2 to 4. Now the provocation for filing the writ petition is that without considering and disposing of representations, at the instance of a few sizeable land holders, road through assigned land in Sy.Nos.313 and 372 is laid.

After perusing the material available on record, prima facie this Court is of the view that before taking a final decision in this behalf, respondents 2 to 4 ought to have considered the grievance of petitioners and communicated the decision taken thereon. Since the representations remained unattended, the writ petition is disposed of by this order.

The petitioners are given liberty to re-submit representations dated 24.11.2016 and 29.05.2017 by enclosing a copy of this order within two weeks from today.

Respondents to are directed to consider representations and pass orders within six weeks thereafter. Till a decision is taken and communicated, respondents 2 to 4 are directed not to change the physical features of Sy.Nos.313 and 372 of Remidicherla Village, Yerrupalem Mandal, Khammam District.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
