THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CRIMINAL PETITION No.981 of 2017 ORDER:
The present petition, under Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C.), is filed by the petitioners/Accused Nos.2 and 3 requesting to quash the proceedings in C.C.No.41 of 2016 on the file of Judicial Magistrate of First class, Yellareddy, PS Lingampet, Nizamabad District.
The petitioners, who are arraigned as Accused Nos.2 and 3 in the aforesaid crime, alleged to have committed offences punishable under Sections 498-A, 506, 232, 290 of the Indian Penal Code (IPC). Heard Sri Rajashekar Thallapally, learned counsel for the petitioners and the learned Additional Public Prosecutor for the State of Telangana on behalf of respondents.
Learned counsel for the petitioners 2 and 3, who are paternal uncle and aunt of the 1st accused, who is the husband of the 2nd respondent pleads their innocence and false implication. He would also submit that while filing charge sheet, the investigating officer has arrived at the conclusion that there is no material worth the name against A4 to A9. Therefore, their names were deleted.
Learned Additional Public Prosecutor for the State of Andhra Pradesh on behalf of respondent No.1 would point out the allegations in
the complaint as well as in the charge sheet. The complaint lodged by the defacto complainant, and the charge sheet averments would clearly show that it is not a fit case to quash the proceedings in the aforesaid Calendar Case.
Accordingly, the Criminal Petition is dismissed. Miscellaneous applications, if any pending in the present petition, stand closed.
