THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.25761 of 2018 ORDER:

Petitioners pray for the following relief:

".........Writ of Mandamus declaring the action of the respondent No.5 in passing impugned order dated 06-07-2018 in ROC.No.E1388008/2018 is without jurisdiction and without any power and arbitrary, illegal, unjust and in violation of Gazette Notification No.143 of Respondent No.1 dated 16-032018 and in violation of the G.O.Ms.No.80 of 2010 dated 22-04-2010 of Respondent No.2 and in violation of rights guaranteed under the Constitution of India and in violation of Principles of Natural Justice and set-aside the impugned order dated 0607-2018 in ROC.No.E1388008/2018 including all proceedings and consequently direct the Respondents to permit the petitioners to run the Brick Kiln manufacture units in the respective lands by directing the respondents not to interfere with the possession of the petitioners over the land ......."

Since the explanation is already filed, this Court is not convinced to entertain the writ petition. The writ petition is dismissed. The dismissal of writ petition shall not be understood as this Court dealt with the merits of the matter.

The 5th respondent is directed to consider the explanation and dispose of the case as expeditiously as possible, preferably within four weeks from the date of receipt of copy of this order.

No order as to costs.

Miscellaneous petitions, if any, pending, shall stand closed.
