HON'BLE SRI JUSTICE A. SHANKAR NARAYANA APPEAL SUIT No.1867 OF 2001 JUDGMENT:
The present appeal is preferred by the plaintiff in O.S.No.9 of 1979 on the file of Senior Civil Judge, Parvatipuram, aggrieved over the judgment and decree, dated 05.02.2001, rendered in the said suit, whereby and whereunder, the Court below dismissed the suit.
2. The appellant - plaintiff is described thus: "The Girijan Diety Jakaradevata alias Goddalidevata of Basangi represented by next friend and Trustee, Jeelakarra Chandrayya, aged 50 years, son of Chinnayya hereditary - Trustee of Jakaradevata alias Goddalidevata Temple at Basangi, residing at Basangi Village, Ziyyammavalasa Mandal, Vizianagaram District."
3. One Jeelakarra Chandrayya is shown as the hereditary trustee of the appellant - plaintiff - institution.
4. Since, there was no representation for the party-in-person on 02.08.2017, the Registry was directed to list the present appeal under the caption "for dismissal".
5. Today also, there is no representation. Party-in-person is not present. The case bundle shows that Sri C.S.K.V.Ramana Murthy, learned counsel, filed vakalat for the appellant.
6. Hence, the present appeal is dismissed for non-prosecution. Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
