THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO Writ Petition No.5036 of 2001 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) The proceedings under challenge in this writ petition is the demand notice in Memo dated 16.03.2001 issued by the Regional Transport Officer, Medak at Sangareddy whereby the petitioner was called upon to pay Rs.25,300/- towards tax, and Rs.69,750/- towards penalty.
While several contentions are urged by Sri P.Laxma Reddy, learned counsel for the petitioner, regarding the validity of the impugned demand notice, it is wholly unnecessary for us to consider all these aspects, as an order of interim suspension was passed, in W.P.M.P.No.6432 of 2001 dated 20.03.2001, on condition that the petitioner deposited Rs.20,000/- within four weeks from the date of the order. Sri P.Laxma Reddy, learned counsel for the petitioner, would submit that, in compliance with the interim order, the petitioner had deposited Rs.20,000/-. If that be so, the balance amount due towards tax is only Rs.5,300/-.
As the writ petition has been pending on the file of this Court for the past 15 years, and the registration certificate issued for the vehicle may no longer be valid, we consider it appropriate to dispose of the writ petition directing that the petitioner shall pay the balance tax due of Rs.5,300/- within four weeks from today; and, in the light of the fact that more than 15 years have elapsed, the respondents shall re-consider whether penalty should be imposed on the petitioner.
The writ petition stands disposed of accordingly.
Miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
