No.90 of 2014 pending on the file of Judicial Magistrate of the First Class, Jagtial.

2) The contentions are that the so called stock was kept in the premises of the petitioner belongs to the Primary Health Centre, Sarangapur, Karimnagar District and the letters addressed by the in-charge medical officer and the pharmacist who was entrusted to hand over the stock to area hospital, Jagtial on loan basis to return after securing the stock by them, instead of directly handing over there while in transit, kept in the night of 11.03.2014 and thereby the prosecution is not sustainable under Section 22(c) and 22(c)(c)(a) and Section 27 read with 18 of the Drugs and Cosmetics Act, 1940.

3) Heard the learned counsel for the petitioner as well as the 1st respondent represented by the Public Prosecutor before admission of the petition and before order any notice to the Drugs Inspector-2nd respondent and perused the material on record from the facts supra. 4) The so called letters said to have been executed by the medical officer as well as pharmacist is in issue that is to be decided only while hearing on charges including as to the genuineness. If it is at the P.R.C stage from what the petitioner submits that it is a trial contemplated as sessions trial.

In fact as per the provisions, it is a private warrant procedure and even there from before framing charges, the evidence of the complainant and witnesses, unless the witnesses evidence is dispensed with, to be recorded and accused got the liberty either to cross-examine or differ the cross-examination in the course of that enquiry before framing charges. As such, by giving liberty to the petitioner to chose for cross-examination and confront the letters to decide the genuineness and to discharge there from if there are no grounds to frame charge or to proceed with if there are grounds to frame charge. 5) Subject to the above observations and without prejudice to such right to the petitioner, the petition is disposed of, for no grounds to admission or to grant stay the proceedings.
