HON'BLE SRI JUSTICE S.V.BHATT W.P. No.30911 OF 2012 ORDER:

Heard Mr.P.Sree Ramulu Naidu for petitioner and the Assistant Government Pleader (Home) for respondents.

The petitioner complains against inaction of respondents in registering and disposing of complaints dated 20.08.2012 and 16.07.2012 as illegal, contrary to procedure stipulated by law and unconstitutional.

The 1st respondent on receipt of notice and explaining the circumstances within 1st respondent's knowledge on the dispute between the petitioner and the 2nd respondent, at the end of the counter affidavit has stated thus:

"It is humbly submitted that if the petitioner approaches this respondent with any fresh complaint certainly, this respondent is ready and willing to initiate action by following the due procedure as contemplated under law. I humbly submit that there is no intention in registering a case on the complaint of the petitioner herein but in the absence of receipt of the alleged complaint, this respondent is unable to take any action.

Mr.Sree Ramulu Naidu submits that the said statement may be placed on record and the writ petition closed by giving liberty to petitioner to approach the 1st respondent if a cause subsists. The prayer is accepted by placing on record the stand of 1st respondent in Paragraph 6 of the counter affidavit. The writ petition is disposed of. No order as to costs.
