Heard learned counsel for the petitioners and learned Government Pleader for Revenue for respondents 1 to 4. 2.

Petitioners state that the first petitioner was assigned Ac.0-32 guntas of land in Sy.No.146/20 of Kasipet Village. He is in possession and enjoyment of the said extent of land. While so, in the same extent of land a proposal was moved for construction of primary health Centre and construction activity is already taken up. Petitioners allege that the said action is illegal. In support of the claim that first petitioner's name is reflected in the revenue records, the pahani copy issued on 29.12.2019 is filed as Ex.P.3. Petitioners also filed photographs showing the construction activity. Alleging that the said action is not valid in law, a representation was made by the second petitioner to the Tahsildar, on 12.12.2019 and to the Sub-Collector, Bellampally, on 19.12.2019. Alleging that inspite of making representations, so far no steps are taken to remedy their grievance and on the contrary construction activity is going on and in the event if building is completed, grave prejudice would be caused to the petitioners. 3.

In view of the said submissions, without expressing any opinion on merits, the Writ Petition is disposed of, directing the Tahsildar-4th respondent to examine the claim of petitioners as ventilated in the representation dated 12.12.2019 addressed to him and the representation submitted to the Sub-Collector on 19.12.2019, within one week from the date of receipt of copy of this order. If the assignment granted to the fist petitioner is not

- 3 - cancelled and the construction activity is taken up in the land of petitioners, without following the due process, they shall not be dispossessed and no construction activity can be taken up.
