HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10751 OF 2017 ORDER:

This writ petition is filed complaining about the coercive steps adopted by the 2nd respondent for collection of the property tax. Learned counsel for the petitioner submits that it is only at the instance of the 3rd resonant, the municipal authorities are coercing the petitioner, who is in occupation of the property to the extent of locking up of the premises.

Sri Sampath Prabhakar Reddy, learned Standing Counsel for the GHMC, on instructions submits that the allegation made by the petitioner is false. However, submits that the authorities have visited the petitioner's premises for collection of the tax, especially considering the fact that in the month of March they are required to collect the taxes in view of the year end.

Considering the submissions made by the learned counsel for the petitioner that the petitioner is in occupation of the ground floor of the property and, accordingly without prejudice to his right, he is ready to pay the tax amount, if sufficient time is granted, eight weeks time is granted to pay 1/3rd of the disputed tax amount towards his share i.e., Rs.45,000/-, from the date of this order. The respondent authorities are at liberty to collect the balance amount from the other occupiers / tenants. With the above direction, the Writ Petition is disposed of. No order as to costs.
