HON'BLE MRS JUSTICE ANIS C.M.A. No. 4260 of 2004 JUDGMENT:

This Civil Miscellaneous Appeal is filed challenging the order dated 01.09.2004 passed by the Senior Civil Judge, Machilipatnam, in I.A.No. 805 of 2003 in O.S.No. 134 of 2003. As seen from the record, the Senior Civil Judge, Machilipatnam vide his letter dated 03.6.2016 informed that O.S.No. 134 of 2003 was for partition and the Court had passed a preliminary decree on 4.10.2012.

In view of the same, this Civil Miscellaneous Appal has become infructuous and accordingly, the same is dismissed as infructuous. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, pending if any, shall stand closed.
