Smt. Marskola Jaywanth Bai v. The State Of Telangana
HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO W.P.No.15058 of 2017
ORDER
This writ petition is filed seeking a direction to respondents 1 to 4 to provide police protection to the land of the petitioner in an extent of Ac.8.00 situated in Sy.No.12/45 of Pippaldhari Village and Mandal, Adilabad District, from the 5th respondent. The petitioner states that she filed a suit for perpetual injunction before the 3rd respondent in Agency Suit No.A/1289/2011 and the same was decreed on 2.4.2013 against the 5th respondent. In spite of the same, the 5th respondent is interfering with her possession. The petitioner submitted a representation on 17.5.2013 to the 3rd respondent, who, vide letter dated 25.5.2013 directed the Sub Inspector of Police Rural, Adilabad, to provide protection to the petitioner. Thereafter, she submitted another representation on 10.10.2016 to respondents 2 to 4.
A perusal of the aforesaid representations shows that the same are mere intimations of the decree obtained by the petitioner in her favour and no request for actual protection of the police is made. It is difficult for the respondent-police to protect the land of the petitioner on all days and at all times.
In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to submit a representation/complaint to the
Station House Officer concerned, if actual interference is going to take place and if there is a likelihood of breach of peace. As and when the petitioner submits such representation, depending the facts of the case, the Station House Officer concerned, shall take appropriate action in accordance with law. No costs. Miscellaneous petitions, if any, pending shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 25th April, 2017 rkk
