The criminal petition is filed under Section 482 Cr.P.C. to quash the proceedings in FIR.No.51 of 2015 of Noothankal Police Station, Nalgonda District. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor, representing the State. Basing on the complaint lodged by the 2nd respondent/complainant, which was forwarded by the Judicial Magistrate of First Class, Thungathurthy, the police registered a case against the petitioner herein for the offences punishable under Sections 419, 420 and 120-B IPC.
The allegations in the complaint, prima facie, reveal the commission of offences punishable Sections 419, 420 and 120-B IPC by the petitioner herein. This is a matter which requires investigation by the police, and there are no valid grounds to quash the First Information Report.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation, however, without arresting the petitioner in FIR.No.51 of 2015 of Noothankal Police Station, Nalgonda District. Pending miscellaneous applications, if any, shall stand closed in consequence.
