SKK,J WP_29575_2016 O R D E R:- The main grievance of the writ petitioner is that even though he got issued a Legal Notice dated 02.07.2016 through Advocate to the 6th respondent asking him not to make any attempts to dispossess the petitioner from his property in an extent of Ac.5.81 cents of land in old Sy.No.138 and new Sy.No.340/ 1 (after sub-division) situated in Ramarayudupeta, H/ o.T.Sirasapally, Munagapaka Mandal, Visakhapatnam District without paying any compensation / exgratia as per his entitlement, so far, neither the legal notice has been considered nor any compensation has been paid. The learned Government Pleader for Land Acquisition appearing for respondent Nos.1 to 5, on instructions, has submitted that decision will be taken on the legal notice dated 02.07.2016 within the time that may be stipulated by this Court.
Keeping in view the averments made in the writ affidavit and the submission of the learned Government Pleader, this Court is inclined to dispose of the writ petition by directing the official respondents to consider the Legal Notice dated 02.07.2016 said to have been sent by the petitioner through Advocate, and pass appropriate orders thereon, within a period of four weeks from the date of receipt of a copy of this order and communicate the decision
SKK,J WP_29575_2016 that may be taken to the petitioner within a period of one week thereafter. Till such time, the petitioner shall not be dispossessed from the land in question if not already dispossessed.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
