Admission And Fee Regulaotory Committee v. A.A.M.Educational Development And 3 Othes
THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN AND THE HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN WRIT APPEAL Nos.125, 127, 128, 129, 130, 131, 132, 133, 134, 135, 136, 137 AND 148 OF 2017 COMMON JUDGMENT: (Per the Hon'ble the Chief Justice Sri Thottathil B. Radhakrishnan) Admission and Fee Regulatory Committee for Matters relating to Fee Fixation in Private Unaided Professional Colleges (AFRC), Hyderabad, is the appellant. The matter relates to fixation of fees before commencement of academic year.
The learned counsel for the appellant (AFRC) is correct in pointing out that such appeals are held not sustainable at the instance of AFRC, which is essentially an adjudicating body (see Judgment, dated 18.07.2018, in W.A.Nos.224 and 225 of 2017). We, therefore, refuse to interfere with the impugned order through this bunch of Writ Appeals, however, clarifying that whatever directions have been granted, will not by themselves operate as a precedent for the succeeding years and the matters would be dealt with independently insofar as coming years and block periods are concerned.
The Writ Appeals are accordingly dismissed. The miscellaneous petitions pending in these Writ Appeals, if any, shall stand closed. There shall be no order as to costs.
