THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 10518 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/accused No.4 seeking anticipatory bail in the event of his arrest in connection with Crime No.79 of 2023 on the file of Chinnagudur Police Station, Mahabubabad District, registered for the offences punishable under Sections 366, 366-A and 376(2)(n) of Indian Penal Code, 1860 and Section 5 read with Section 6 and Section 6 read with Section 17 of the Protection of Children from Sexual Offences Act, 2012.

Heard learned counsel for the petitioner/accused No.4 as well as learned Additional Public Prosecutor for the respondent-State and perused the record.

As seen from the record placed before this Court, this Court by Order dated 18.10.2023 granted the relief of anticipatory bail to accused No.3, who is the mother of the petitioner herein, vide Criminal Petition No.10406 of 2023. The allegation is that accused No.1 had taken victim girl on 12.09.2023 to Secunderabad and there from to B.N.Reddy colony. The next day he went to the house of accused No.3. The only allegation against the petitioner herein and his mother is that they provided shelter to the victim girl and accused No.1.

Since there is no allegation leveled against the petitioner herein regarding any force or any kind of inducement, the petitioner herein can be granted the relief of anticipatory bail, subject to the following conditions:

1) The petitioner/ accused No.4 is directed to surrender before the Station House Officer, Chinnagudur Police Station, Mahbubabad District, on or before 30.10.2023. On such surrender, the said Station House Officer shall release the petitioner/accused No.4 on bail, on his executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner/accused No.4 shall appear before the concerned Station House Officer, on every Monday, for a period of eight(8) weeks between 10.00 A.M. and 1.00 P.M. and thereafter, as and when required for the purpose of investigation.

3) The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
