K. G.V.S Rambabu v. The Andhra Pradesh State Road Transport Corporation
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.39183 of 2016 ORDER :
Heard the counsel for petitioner, and Sri A. Rama Rao, learned Standing Counsel for Andhra Pradesh State Road Transport Corporation, for respondents.
2.
The petitioner has filed this Writ Petition challenging the order dt.26.10.2016 of the 2nd respondent suspending the petitioner, pending enquiry.
3.
Subsequently, charge-sheet was also issued to petitioner on the same day.
4.
Though the counsel for petitioner contended that the charges framed against petitioner are false, I am not inclined to go into the said issue since the petitioner would have an adequate opportunity to disprove the allegation in the proposed disciplinary proceedings. 5.
Since it is not the case of petitioner that the order placing him under suspension is without jurisdiction, and since the charge memo has already been issued on the basis of the suspension order, I am not inclined to consider the submissions of petitioner on the validity of the order placing him under suspension.
6.
Therefore, the Writ Petition is dismissed. No order as to costs.

7.
However, the 2nd respondent shall complete the enquiry initiated against petitioner pursuant to the charge-sheet dt.26.10.2016 within a period of four (04) months from the date of receipt of a copy of this order.
8.
As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
