The grievance of the petitioner is that the 3rd respondent is not filing charge sheet in Cr.No.83 of 2011 dated 04-032011. Learned Assistant Government Pleader for Home produced written instructions stating that on receipt of the complaint in the said crime, the matter was enquired into and investigation is completed. After obtaining permission from the Assistant Commissioner of Police, Shamshabad, the case was treated as 'lack of evidence'. The petitioner was also informed of the same by registered post on 13-10-2015. It is to be seen that when the respondent-police found that the case was treated as one 'lack of evidence' and final report is filed, the same should have been filed in the concerned criminal Court after issuing notice to the petitioner.

It is stated that notice was issued to the petitioner, but learned counsel for the petitioner disputes the same. In view of the same, the Inspector of Police, Shamshabad is directed to file report before the concerned Court after issuing notice to the petitioner within a period of one week from the date of receipt of a copy of this order. It is open for the petitioner to avail alternative remedy available to him under law.

With the above direction, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 31-07-2018 Nvl
