THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.42619 of 2016 ORDER:
This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to quash the proceedings against him in Crime No.94 of 2016 on the file of Zaheerabad Police Station, Medak District. Heard and perused the material available on record. The petitioner is working as a Junior Assistant in the Sub-Registrar Office at Zaheerabad. The allegation against the petitioner is that the other accused, by creating forged documents, intended to register a property with the help of the petitioner. The other accused were already arrested and released on bail. The grievance of the petitioner is that basing on the confession of the other accused only, he was added as an accused and there are no specific allegations against him.
The petitioner filed this writ petition challenging the investigation in the above crime. This Court is not inclined to interfere with the investigation. However, taking into consideration the facts and circumstances of the case and the grievance of the petitioner, this Court is of the view that the investigation can be completed without arresting the petitioner. Accordingly, 4th respondent is directed to complete the investigation and file a final report in the above Crime, in accordance with law in either way, without arresting the petitioner. The petitioner is directed to appear before the investigating officer concerned, daily between 10.00 am and 5.00 pm, for a period of ten (10) days, from December 22, 2016 and also execute a personal bond for a sum of Rs.50,000/ - (Rupees fifty thousand only) with one surety for the like sum for his future appearance, as and when required for the purpose of investigation.
With the above directions, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
