Seeking the Court to enlarge the petitioner, who arrayed as accused in Crime No.797 of 2025 of Mailardevpally Police Station, Cyberabad Commissionerate, on bail, the present petition is filed. 2 .

The brief facts of the case are that on 12.08.2025, de-facto complainant lodged a report with the Police stating that she had married Mohd. Mateen ten years ago but was divorced within a year. In 2019, Mohd Muneer (the accused) rented a portion of her house and later he promised to marry her. Trusting his words, the complainant entered into a sexual relationship with him based on his repeated assurances. Later, the accused brought his family to the house, and the complainant discovered that he was already married. Upon learning of the affair, Muneer's wife vacated the premises. Despite this, Muneer continued the relationship with the complainant under false promises, and they began living together. In the last 15 days, when the complainant insisted on marriage, the accused refused and allegedly threatened her with dire consequences, as such requested for necessary legal action. Basing on the said complaint, the Police registered a case vide

Crime No.797 of 2025 for the offence punishable under Section 69 of BNS.

Heard Sri Siddharth Panwar, learned counsel appearing on behalf of Sri Mohd. Muzaferullah Khan, learned counsel for the petitioner as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State. 4.

Learned counsel for the petitioner submitted that no offence, as alleged, has been committed by the petitioner, and that the relationship between the petitioner and the de-facto complainant was consensual. He further submitted that the petitioner was arrested on 18.08.2025 and has been in custody since then and a substantial portion of the investigation has already been completed. Therefore, prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the allegations against the petitioner are grave in nature and the investigation is still ongoing, releasing the petitioner on bail at this stage may lead to tampering with evidence or intimidation of witnesses and prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is evident from the complaint itself that the petitioner and the victim have been in a relationship since 2019. Even after becoming aware that the petitioner was a married person, the complainant did not lodge any report with the police until 2025, resulting in a considerable delay. The petitioner has been in judicial custody since 18.08.2025. The remand report indicates that twelve witnesses have been examined thus far. Considering the overall facts and circumstances of the case, including the nature of the allegations, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner, subject to the following conditions: i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned XII Additional Judicial Magistrate of First Class, Ranga Reddy District at Rajendranagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier,

for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
