THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.11701 OF 2025 ORDER :

This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/A.5 seeking to enlarge him on bail in connection with Crime No.514 of 2025 of Chevella Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are under Sections 318 (4), 179 and 180 of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS').

The case of the prosecution is that on 24.07.2025 the complainant lodged a report before police stating that about six months ago his cousin brother introduced him to Mulukuntla Sanjeev Kumar. The complainant was further introduced to Dharmender from Adilabad through Srinivas from Asifabad and to Pujari Yogendra, and his assistant. On 18.07.2025, they took complainant to Adilabad, conducted a fake ritual, and collected Rs.1,100 from him. Later, they convinced him to arrange Rs.21 lakhs for performing bigger puja, for which he would receive Rs.5 to 11 Crores. They further stated that the money received from puja should not be the same money used for the ritual and that puja would not be effective during rainy season and it would be effective during dry season. On 24.07.2025 Lw.1 and

- 2 - A.4 went to Adilabad to meet A.1 and A.2 and they took bundles of fake notes from the unknown person and for using the same for rain money to get wrongful gain from the complainant and asked him to get Rs.21 Lakhs in cash and one gram gold coin in a bag for performing the pooja. Accordingly, the complainant handed over the money and gold coin at a location near Chevella. During the so-called ritual, A1 switched off the complainant's phone, took it away, and absconded with A2 and the bag containing Rs.21 lakhs and the gold coin. When the complainant returned after a short while, he found both accused missing and his phone left behind. Despite efforts, the accused could not be traced. Hence, requested the police to take legal action against the accused. Basing on the said complaint police registered the case against the accused. 3.

Heard Sri D. Ramakrishna, learned counsel for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioner is that the petitioner is in jail from 24.07.2025 and material part of investigation is already completed. There are no specific overt acts against this petitioner. A.1 and A.2 are already granted regular bail by the trial Court and as the prime accused were

- 3 - already granted bail, petitioner herein is also entitled for bail and requested this Court to grant bail to the petitioner. 5.

On the other hand, learned Additional Public Prosecutor opposed bail stating that the allegations are serious in nature. In fact the petitioner herein has introduced the defacto complainant to A.1. As such, his custodial interrogation is necessary and all the allegations are serious in nature. Hence, requested this Court not to grant bail to the petitioner and to dismiss this petition.

Considering the submissions made by both the counsel and the material placed on record, the petitioner is in jail from 24.07.2025 and A.1 and A.2 are already released on bail. Further material part of investigation is also completed and prosecution examined Lws.1 to 11. Considering the same, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

i.

The petitioner/A.5 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of XVIII-Additional District & Sessions Judge at Chevella.

ii.

The petitioner/A.5 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for

- 4 - the purpose of investigation and thereafter, as and when required.

iii.

The petitioner/A.5 shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
