WRIT PETITION No.29967 of 2015 ORDER :
Heard learned counsel for petitioner and Sri Pasam Krishna Reddy, learned Standing counsel for the Respondents 1 and 2 and with their consent, the writ petition is taken up for disposal at the admission stage.
2. This writ petition is filed questioning the action of the respondents 1 and 2 in not taking action on the representation of the petitioner dated 20.08.2015 regarding illegal constructions made by the 3rd respondent in house bearing No.16-11-20/27/4, Saleem Nagar Colony, Saleem Nagar, Malakpet, Hyderabad, as illegal.
3. The petitioner is the owner of house bearing No.16-11-20/27/8, Saleem Nagar Colony, Malakpet, Hyderabad, situated near the house of 3rd respondent. The petitioner alleges that the 3rd respondent encroached the public road and the plot of the petitioner and constructed a house bearing No.16-11-20/27/4, consisting ground + 2 floors, Saleem Nagar Colony, Saleem Nagar, Malakpet, Hyderabad, without obtaining permission from the respondent-Corporation and raised construction illegally. Alleging such illegal constructions the petitioner has submitted a representation on 20.08.2015 to the respondents 1 and 2. But so far no action is taken. Hence, this writ petition.
4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondents 1 and 2 to expeditiously dispose of the representation dated 20.08.2015 submitted by the petitioner.
5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondents 1 and 2 to consider the representation of the petitioner dated 20.08.2015 and pass appropriate orders as warranted under law within a period of six weeks from the date of receipt of copy of this order and communicate the decision to the petitioner. The respondent authorities are directed to put the 3rd respondent on notice, before passing the orders on the representation of the petitioner. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
