THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25607 of 2018 ORDER:

When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned Government Pleader for Excise that the issue, in the present Writ Petition, is squarely covered by the order, dated 19.06.2018, passed by this Court in W.P.No.20275 of 2018. A copy of the said order is placed on record.

Following the above said order and for the reasons recorded therein, this Writ Petition is allowed, setting aside the order passed by the first respondent, vide Memo No.25818/Ex.II(2)/2017-2, dated 16.05.2018, and the revision filed by the petitioner stands restored to file for consideration of the first respondent, in accordance with law, after giving opportunity of personal hearing and by taking into consideration the observations indicated supra. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
