HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.19426 of 2009 ORDER :

Heard Mr.A.Ravinder for petitioner and Mr.A.Prabhakar Rao for respondent No.4 and the Assistant Government Pleader for respondents 1 to 3. The petitioner assails the order dated 02.09.2009, which reads thus;

" The Revenue Divisional Officer, Warangal has issued proceedings by appointing Sri Rajaboina Kumaraswamy S/o.Komuraiah R/o.H.No.20-14-44, East Fort, Warangal as Fair Price Shop Dealer for the FP Shop No.287 of Fort Warangal.

Smt.K.Uma Rani W/o.Krishna, R/o.H.No.20-1614, East Fort, Warangal filed an appeal under clause 20 of A.P.P.D.S. (Control Order) 2001 against the orders passed by the Revenue Divisional Officer, Warangal in Proceedings No.E/1168/2009, dt.24-012009 through her counsel. The appeal has been taken on file. The orders of the Revenue Divisional Officer, Warangal issued in Proceedings No.E/1168/2009, dt.24-01-2009 is hereby suspended.

The Revenue Divisional Officer, Warangal is directed to submit the remarks along with connected record of the lower court pertaining to the case of appellant."

On 14.09.2009, this Court granted interim suspension of order dated 02.09.2009. At the time of hearing, learned counsel appearing for the petitioner submits that Appeal No.11 of 2009 is still pending before the 1st respondent/Joint Collector (Civil Supplies), Warangal and the appeal can be directed to be disposed

of expeditiously. I am satisfied by this order, the writ petition can be disposed of. Interim order granted on 14.09.2009 is directed to be maintained till the disposal of Appeal No.11 of 2009 and communication of that order to the petitioner. The 1st respondent is directed to positively dispose of the appeal within three months from the date of receipt of a copy of this order.

Writ petition is disposed of with the above directions. No order as to costs.

As a sequel, pending miscellaneous applications, if any, shall stand closed.
