HONOURABLE SRI JUSTICE P.NAVEEN RAO ORDER:

Aggrieved by the mutation proceedings granted in favour of petitioner, 5th respondent preferred appeal in the form of representation requesting the Revenue Divisional Officer to set aside the mutation proceedings. In response, notice was issued by the Revenue Divisional Officer (filed as Ex.P1). Petitioner claims that he has filed counter opposing the maintainability of the appeal filed in the form of representation and seems to have raised objections on the maintainability of appeal itself on the ground that similar litigation is pending. Alleging inaction in disposing of the appeal, this Writ Petition is filed.

Since notice was issued by the appellate authority and the objections are filed, as briefly noted above, Court is not expressing any opinion, but suffice to dispose of the Writ Petition directing the Revenue Divisional Officer to pass orders on the appeal entertained by him by duly taking note of the objections filed by the petitioner after affording due opportunity to both parties, as expeditiously as possible, preferably within a period of eight weeks from the date of receipt of copy of this order. It is also made clear that this Court is not expressing any opinion on merits and both parties are entitled to raise all the pleas as available in law. Writ Petition is accordingly disposed of. Pending miscellaneous petitions shall stand closed.
